| Well... here's what's LEFT of my ride. Some twit nailed the piss out of my car while pulling out of a BK. Stuffing their face with a BigMac, obviously, and not paying attention while trying to turn left across a 4 lane road... Hit me so hard it knocked my door apart. This is as far as I could get the passenger front door open. And she says she didn't hit me that hard....... All this caused by a 95 Taurus going "5 mph" 5mph my arse......... | ||

| ahh well, just feel lucky she pulled out later rather then sooner or you would have nailed her in the driver side door while she was eating the whopper. Then you'd have a whopper and a lady on your hood and if the whopper is the only one alive then your **** out of insurance. If your lucky you can nab the BK too for shoddy management of their parking lot and absence of warning signs. | ||

| It's possible she realy wasn't going all that fast, but probably more than 5 mph, I assume your car was moving to? If so, you have to add BOTH speeds of the cars to get a better idea of the true forces involved in the impact. For example, If you were doing 25 mph and she was doing 5 mph, the impact force would be 30MPH to the veh. ![]() (You could get real fancy and take into account the angle of impact and other factors, but this is just to give you a ballpark idea) I worked at the crash barrier for Ford for a few years, I would often see that level of damage at around 20-25 mph under controlled conditions, my best guess on the force involved in you accident. Since it was an angular collision it more be a resultant vector illustrated by my professionally done drawing (Paint is 1000000x better than any vector based program) ![]() | ||

| Police are saying that the combined speed of impact is in excess of 60mph... I was going 33... so you do the math. Yet the woman still claims that she was only going 5mph. Which is odd since she left marks in the driveway from peeling out onto the road. Initial estimates so far are nearly $4000. But with McD's being right next door.. it could have been a Bigmac or a whopper... either way.. she was stuffing her face. But yeah, police declared that she was definitely at fault.. even had I T-boned her.. it would have still been her fault due to her failure to yeild. Now she's trying to say that there was damage there already and the didn't cause all of it. That's ok though.. she's got some chump insurance company and I've got Progressive. | ||

| Knowing harrison cops and seeing those pictures I'd say 60 is a little to high. if you were going 33 and she was peeling out i'd say about 40 to 45. looking at the damage to your car I'd say thats close to being right. My friend backed in to my fender and it compleatly crushed the fender. Anyway sorry to hear about that, at least your ok. | ||

| As of right now... with just a 'walk-around' estimate I have damage to the following parts: Front bumper, Radiator, A/C unit, front right quarter panel, passenger front door, front right tire/wheel/rotor, and hood... When you factor in labor, paint, parts, etc (not counting alignment, storage, and towing) it gets expensive REAL quick. | ||

| That impact didn't damage the core support? If not the AC parts are still a fortune and .... what year is your car? You live in Oregon? I would love to get my hands on that repair and estimators for Progressive, here anyways, are great to work with. This accident will all be a memory and your car back to new in no time. Glad you where not injured, cars are a whole lot easier to fix. My only advice for you is to pay attention to what parts they want ot put on your car. Especially the AC parts, all insurance companies will try to find wrecking yard parts for any car that is a few years old. Insurance companies are only required to repair your car to "pre accident condition", the problem is, how vague that statement is. I am not saying that there is going to be problems with your repair, just pay attention to the estimate. Especially to the parts they want to use from the local wrecking yard, used AC compressors and of course receiver/driers are two of those parts I always fight for new. One more thing, find out how much the daily rental car allowance is, if you rent a car and upgrade, you will be paying the extra cost. With as many parts as your car is going to need, your repair shop is not going to be in total control to how long your car will be in the shop......anyway if you do not rent a car, you are legally entitled to that daily allowance, insurance companies fail to mention that to their customers. They will tell you that is only if you rent a car, just tell them after you where told how much the daily allowance was, you gave your friends that amount to drive you to and from work and to your daily errands...... you get the idea. You might not get all of it, but it's always nice to cash checks with your name on it. Insom | ||

| As I mentioned.. the estimate is just a walk-around. They have yet to actually put the car up on the rack or even open the hood for that matter. The total was just from looking through the damaged areas to see what was broken. In regards to where I'm located.. I'm in Harrison, Arkansas. Hondatuner, no doubt, knows the area quite well. Also, I am aware that they must put me back to where I was before the accident or better. The body shop where I got the estimate refuses to use junk yard parts. The gentleman I spoke with said that the estimate is for factory new parts (not aftermarket parts since I didn't have those to begin with). I have spoken with several other people about this body shop and they have all had the highest praises for them. In regards to the rental.. being that I was in a 4dr Sedan before the accident, they are required to put me in a 4dr sedan rental car. From what I understand, however, if the car company requires full coverage on the car.. I would be forced to pay for any coverage above my liability coverage. Also, Progressive is MY insurance company. They aren't actually involved in this case.. it is a company called Cornerstone National Insurance Company. This company seems about as (un)organized as the government is. I wish the woman who had hit me had Progressive.. I know they get the ball rolling quickly. | ||

First, do you have "full-coverage" on your vehicle? If so, just get a copy of the police report and take it to your agent and then just ask what body shops they deal with. Then just drop the car off and let the insurance company handle it from there. As far as the deductible, there are a couple of ways to handle that. First, you can sue the other party for the deductible under "Mini Tort".......but, that only applies to if you have full-coverage insurance or your can deal with the body shop and see if he'll "ignore" the deductible. If you don't have full coverage insurance and the police report says the other party is at fault, you can sue them for repairs and your time-off work..............Either way it sux big time in trying to break even on the situation.......Good Luck !!! | |||||||||||||||||||||||||

| I only have liability insurance and have been in contact with the other person's insurance company. The police report still hasn't been released and I'm still without a rental vehicle. The other driver is claiming no fault even though she pulled in front of traffic, failed to yeild, and conducted an improper turn. It looks like I'm going to end up retaining a lawyer. My insurance company, Progressive, has stepped out of the whole thing since they don't have anything to do with it anymore. According to law, the other driver's insurance company is supposed to put me back to where I was before the accident.... How can they do that? After all... before the accident I had a great vehicle that drove perfectly, I wasn't out the extra cash that all of this has cost me, my neck and back didn't hurt, I hadn't wasted perfectly good cell phone minutes talking to them long distance, and I didn't have the headache of all of this.... Not to mention the fact that had the accident not happened.. I wouldn't have been stranded on the side of the road with two very young children. (Yes.. the cop left us there without making sure that we even had a ride home) | ||
