Post Ubisoft in Trouble Again?

Remember the trouble Ubisoft had over StarForce recently? Well, seems they may have been caught again...

It all comes from the Ubisoft title Heroes of Might and Magic V.

Kerio personal firewall message:

Outgoing Connection Alert!
SendStats.exe wants to connect to lb-iisdt.ubisoft.com [216.98.48.19], port 443

There is no mention about this in the EULA nor during installation or gameplay.

This pertains to the website, not the game:

The language filter would have a field day if I were to express my true feelings toward StarForce neuterware program. I hope Ubisoft and other companies take note of the backlash toward this particular program, and rethink their copy protection software strategy. There have been several games I've considered getting until I found out that they were 'StarForced'. I decided to keep my money on all of them because I really didn't feel like reloading my system over one game.

Its a real shame, I've been looking forward to the new HMM for some time now. Of course, I thought that the titles went downhill since 3DO bought New World Computing and put JVC (Jon Van Caneghem, creator of the original games - 2 of which are now in the Gaming Hall o Fame) thru the ringer so much that he'd rather quit than have his name on a product that didn't meet his standards. But that's a different rant for a different time.

Oh, and if you're wondering where that came from. A little timeline.
JVC created New World Computing in 1983, put out Might&Magic 1-5 and Heroes of M&M 1 under NWC, NWC was bought by 3DO in '96 where they put out M&M 6-9 and HM&M 2-4 (JVC was not involved with M&M 8-9 or HM&M 4, although credited for them, he had left the company by then), and when 3DO went bankrupt, Ubisoft bought the licensing for the HM&M series. Which leads us to the current discussion of why in the world Ubisoft would hamstring the game by including StarForce in it.
