I have a gateway laptop, and recently the screen flickers at startup and somethime in a session. I'm not sure if moving the lid corrects it, but it eventually stabalizes, although I often have to hold my breath as it may go black for 5 seconds. Perhaps it is happening on the lower quarter of a charge.

I tried to update the graphics driver, and although I've never had problems doing this with ATI drivers on my desktop -- after the ati splash screen 'drivers could not be found' I had to roll back to get out of this one. anyway that's another story..

because it happens at startup I think it is a driver issue, while they should be loading. but it also seems to be happening on lower charges.. so then maybe its the battery

does anyone know what could be happening.

Could be a power issue, does it only happen when you are on batttery?

Most likely, it is the inverter board or the backlight.

Yes, but you say it cuts out for 5 seconds, then comes back. So I think the battery (or associated internal circuitry) is flakey.
